Terms of Service

The terms governing your use of the Rideau Earthworks and Demolition website and services.

These Terms of Service (“Terms”) govern your use of the website rideauearthdemo.com (the “Site”) operated by Rideau Earthworks and Demolition (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Services

Rideau Earthworks and Demolition provides earthworks, demolition, and hauling services throughout the City of Ottawa and surrounding Eastern Ontario. The Site provides information about our services and lets you request an on-site estimate or submit project inquiries through our contact and quote forms.

2. Estimates and Scheduling

  • Free on-site estimates are provided for residential and light commercial projects within our service area. Estimates can be requested through our online quote form, by phone, or by email.
  • Quotes are written and outline the scope of work, estimated timeline, and total cost. A quote becomes a binding agreement once you accept it in writing (by email, signed quote, or other confirmation).
  • Scheduling is confirmed in writing after a quote is accepted. We will agree on a target start date and provide updates if anything changes.
  • Rescheduling: we ask for reasonable notice (typically 48 hours or more) if you need to cancel or reschedule confirmed work, so we can accommodate other customers.
  • Weather, site conditions, and equipment availability may require us to reschedule on short notice. If this happens, we will notify you as soon as possible and agree on a new date together.
  • Estimates provided verbally or through the Site’s quote form are preliminary. Final pricing is always confirmed in a written quote before work begins.

3. Payments

  • Payment terms are specified in your written quote and may include a deposit to secure scheduling, progress payments for multi-day projects, and a final balance due on completion.
  • Accepted payment methods (e.g., e-transfer, cheque, credit card) will be specified in your quote or invoice.
  • All prices are in Canadian dollars (CAD) and are subject to applicable taxes, including HST.
  • Late payments: outstanding balances may be subject to interest and collection costs as permitted by Ontario law. Interest terms, if any, will be specified on your invoice.
  • Disputes: if you believe an invoice contains an error, please contact us promptly so we can review and resolve the issue.

4. Use of the Site

You agree to use the Site only for lawful purposes. You may not:

  • Use the Site in any way that violates applicable federal, provincial, or municipal law
  • Attempt to gain unauthorized access to any part of the Site or its underlying systems
  • Use automated tools (bots, scrapers) to access or collect data from the Site without our written permission
  • Transmit viruses, malware, or other harmful code
  • Interfere with or disrupt the operation of the Site or the experience of other visitors

5. Intellectual Property

All content on the Site, including text, images, videos, logos, and design elements, is the property of Rideau Earthworks and Demolition or its licensors and is protected by Canadian copyright and trademark law. You may not reproduce, distribute, publish, or create derivative works from this content without our prior written permission. Personal, non-commercial use (such as viewing the Site and saving a copy of your quote) is permitted.

The Site may contain links to third-party websites or integrate third-party services. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

7. Limitation of Liability

To the fullest extent permitted by Ontario law, Rideau Earthworks and Demolition shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Our total liability for any claim arising from your use of the Site is limited to the amount you paid to us for the specific service giving rise to the claim, or one hundred Canadian dollars (CAD $100), whichever is greater.

The Site is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Nothing in these Terms limits any rights or remedies you have under applicable Ontario consumer protection law, and nothing limits our liability for fraud, gross negligence, or willful misconduct where such limitation is not permitted by law.

8. Indemnification

You agree to indemnify and hold harmless Rideau Earthworks and Demolition, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Site or your violation of these Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the Site shall be resolved in the courts of Ontario.

10. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised “Last updated” date at the top. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
